🛡 Copyright and Intellectual Property Infringement Policy
Last updated: October 23, 2026

DIYGiftly respects the intellectual property rights of others. If you believe that content available on our website infringes your copyright or other intellectual property rights, you may submit a written infringement notice using the procedure below.

Please note that only the copyright or intellectual property owner, or a person authorized to act on the owner’s behalf, should submit an infringement notice.

1. Copyright Infringement Notice

To help us review your claim, your written notice should include:

  • Your physical or electronic signature, or the signature of a person authorized to act on behalf of the rights owner;
  • Identification of the copyrighted work or other intellectual property that you believe has been infringed. If the notice covers multiple works, you may provide a representative list;
  • Identification of the material that you believe is infringing, together with information reasonably sufficient for us to locate it, including the relevant product or page URL;
  • Your full name, mailing address, telephone number, and email address;
  • A statement that you have a good-faith belief that the disputed use is not authorized by the rights owner, its agent, or the law; and
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the rights owner or are authorized to act on behalf of the rights owner.

Please send the completed notice to:

Please use the subject line: Copyright Infringement Notice.

2. Review and Removal Process

After receiving a complete infringement notice, we may investigate the claim and remove or disable access to the material where appropriate.

We may provide a copy of the notice, including the claimant’s contact information, to the person who submitted, uploaded, supplied, or is otherwise responsible for the disputed material.

We may request additional information if the notice does not contain sufficient information to identify the protected work, locate the disputed material, or evaluate the claim.

3. Counter-Notification

If you believe that material you supplied was removed or disabled because of a mistake or misidentification, you may submit a written counter-notification containing:

  • Your physical or electronic signature;
  • Identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled;
  • A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled because of a mistake or misidentification;
  • Your full name, mailing address, telephone number, and email address;
  • A statement that you consent to the jurisdiction of the appropriate United States Federal District Court as required by 17 U.S.C. § 512(g)(3); and
  • A statement that you will accept service of process from the person who submitted the original infringement notice or that person’s agent.

Please send the counter-notification to the Copyright Contact listed above using the subject line: Copyright Counter-Notification.

If we receive a valid counter-notification, we may forward it to the person who submitted the original notice. Subject to applicable law, the removed material may be restored no sooner than 10 and no later than 14 business days after the counter-notification is forwarded, unless we receive notice that the original claimant has filed a court action seeking to prevent restoration of the material.

4. Repeat Infringement

Where appropriate and at our discretion, we may restrict or terminate access for users, suppliers, or other parties who repeatedly infringe intellectual property rights.

5. Misrepresentation

Submitting a knowingly false or misleading infringement notice or counter-notification may result in liability for damages, costs, and legal fees under applicable law.

If you are uncertain whether particular material infringes your rights, you should consider obtaining independent legal advice before submitting a notice.

6. Other Intellectual Property Complaints

For trademark, design, patent, right-of-publicity, or other intellectual property complaints, email support@diygiftly.com with:

  • Your contact information;
  • Identification of the relevant intellectual property;
  • The URL and description of the disputed material;
  • An explanation of why you believe the material infringes your rights; and
  • Evidence that you own the rights or are authorized to act for the rights owner.

Nothing in this policy constitutes legal advice or an admission that DIYGiftly qualifies for any particular statutory limitation of liability.
